What happens if the buyer fails the background check?

For merchandise that must be transferred through a gun dealer, the buyer must pass a NICS background check performed by the gun dealer.

It is possible for a buyer to fail the background check and not be allowed to take possession of their merchandise. However, that does not allow the buyer to file a dispute through GunTab. It is the buyer’s responsibility to know their legal status and maintain a clean record. The buyer is not entitled to a refund for failing that responsibility.

If a buyer fails the background check, the buyer should coordinate with the FFL to sell the merchandise either to the FFL, or to a new seller. For example, the buyer might post the item for sale on GunBroker. Once it is sold, the buyer should instruct the FFL to ship it to the new buyer.
